Services
EK Studio provides various design services, such as graphic design, web design, logo design, branding, and more. You can browse our portfolio, request a quote, or contact us for more information. We will do our best to meet your expectations and deliver high-quality work.
Payment
Payment When you request a quote for our services, we will send you an invoice with the details of the project, the price, and the payment method. You agree to pay 50% of the invoice amount as a deposit before we start working on your project, and the remaining 50% as a balance after we deliver the final product. We accept payments via cash, credit card, or bank transfer. If you have any questions or issues with the payment, please contact us as soon as possible. Please note that the payment terms may vary depending on the nature, scope, and duration of the project, and we will inform you of any changes before we start working on your project.
Delivery
We will deliver the final product of your project via email or any other agreed-upon method. We will also provide you with the source files and any other relevant files. You are responsible for downloading and saving the files to your own device. We are not liable for any loss or damage of the files after we deliver them to you.
Revisions
We offer up to two revisions for each project, free of charge. If you are not satisfied with the final product, you can request a revision within 14 days of the delivery date. We will make the necessary changes and send you the revised product as soon as possible. Any additional revisions beyond the two free ones will incur extra charges.
Cancellation and Refund
You can cancel your project at any time before we start working on it. In that case, we will refund you the full amount of the payment. However, if you cancel your project after we have started working on it, we will not issue any refund. You will still receive the product as it is at the time of cancellation.
Intellectual Property
We retain all rights, title, and interest in and to the original elements of the design work we create for you, such as the concepts, sketches, drafts, and source files. You are granted a non-exclusive, non-transferable, non-sublicensable license to use the final product of the design work for your own personal or commercial purposes, in accordance with these terms and any other agreement we may have with you. You may not copy, modify, distribute, sell, or otherwise exploit the design work without our prior written consent.
Disclaimer
We provide our services on an “as is” and “as available” basis, without any warranties of any kind, either express or implied. We do not warrant that our services will be error-free, uninterrupted, secure, or meet your requirements. We are not responsible for any damages or losses that may arise from your use of or inability to use our services, or from any errors, omissions, or inaccuracies in the design work we create for you.
Limitation of Liability
To the fullest extent permitted by law, we are not liable for any direct, indirect, incidental, consequential, or punitive damages, or any other damages of any kind, arising out of or in connection with these terms, our services, or the design work we create for you, even if we have been advised of the possibility of such damages. Our total liability to you for any claim or cause of action under these terms will not exceed the amount you have paid us for the relevant service.
Indemnification
You agree to indemnify, defend, and hold harmless us, our affiliates, partners, employees, contractors, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, and fees (including reasonable attorneys’ fees) that arise from or relate to your use of or inability to use our services, or your violation of these terms or any other agreement we may have with you.
Governing Law and Jurisdiction
These terms are governed by and construed in accordance with the laws of Tunisia, without regard to its conflict of laws principles. You agree to submit to the exclusive jurisdiction of the courts of Tunisia for any dispute arising out of or in connection with these terms, our services, or the design work we create for you.
Changes to These Terms
We reserve the right to modify or update these terms at any time, at our sole discretion. We will notify you of any changes by posting the new terms on this page. You are advised to review this page periodically for any changes. Your continued use of our services after any changes constitutes your acceptance of the new terms.
